Wrongful termination or?

My sister has been watching my kids while I left town to have my son. We are still out of town as my son is having medical issues. She asked her work if she could work from home for the afternoons to accommodate my 5 year old who is in a full leg cast & a wheelchair. He can’t stay at school all day due to his wheelchair & he just isn’t comfortable so from time to time he asks to go home early. They allowed her to.
Due to my newborns medical issue our stay in the city hospital has extended 3 times. I’m unsure when I will be returning home. My kids dad isn’t involved in their lives so he can’t help me or my sister out & my partner has been with me for our newborn. My sister talked to HR explaining to them the issue & they told her if I’m not home by Monday they will be firing her. ??? Can she fight this?

Yes they can and no this isn’t wrongful termination. She would need  to use FMLA or vacation, etc.

How far is the drive ? Can your partner take care of the child while she goes to work, and goes to the hospital when she’s off ?

Sadly, no. Even if it was her own child, she would need to qualify for FMLA and file for it to have any kind of job protection. But unfortunately, extended family is not protected by FMLA. Theyre being aholes but theres no recourse ( if youre in the U.S., overseas may be different laws)

Maybe she can ask to shift hours or see what they can do. 
If she is not providing the work product expected, I get that from a corporate side (visualizing someone in a role like mine as a paralegal). She could request fmla, not sure how the lines go for a nephew vs own child.
