Does this matter?

My kids’ dad is flaky. Hasn’t seen them in almost 3 years and they’re only 3 (twins). He forfeited all custody years ago because he didn’t show up. I tried to give him another chance a month ago. He flaked on the first visit I offered but then went to court and is claiming to want unsupervised weekends. They ordered him to do a psychological evaluation and was given two weeks to do it. I got a call from the court on the LAST DAY he had and they told me he says his evaluation isn’t until the 21st of January. So they’re rescheduling our hearing for February. I think it’s really weird he waited until last minute (unless it was sooner and they just didn’t tell me) and is needing another MONTH. Unless with holidays and what not.

ANYWAYS. I haven’t heard from him at all. Not even just to ask if they are doing okay. I’m assuming it’s because he’s upset I won’t just let him do what he wants, he’s always been like this - if he gets upset about something, just doesn’t answer or talk anymore. I definitely don’t anticipate hearing from him until court either. By the time court hits, it will have been 2 1/2 months since he’s asked about them. Can this be something to mention? Or will courts not care since he’s at least participating in court requirements?
