I know this sounds stupid.😕

So my boyfriend turns 18 next Sunday and I just turned 17 in April. He thinks that if we get caught having sex after he turns 18 he will get in trouble with the police. We live in North Carolina and from my understanding the age of consent is 16. Am I wrong for telling him there's nothing to worry about?
