My babies 5 weeks old and his dad wants to take him to his house. We have no court order so if he takes him he doesn't have to return him. And out FIRST meetingbisnt wven until the middle of November. He wasn't being very nice today and I told him he can't come over. Can this really be used against me in court? That I won't let him see the baby. What mother would risk not seeing their baby again til court? Am I being irrational?

You need to contact a lawyer ASAP to protect your rights and don't hand the baby over until you have a custody agreement in place.

Much more information is needed. But first, contact a lawyer! You can get free consultations where they will just give you a basic run down of your rights. In some states if he's on the  birth certificate or if you were married he has just as much physical rights with the baby as you. In other states it's different so it really depends on where you're located. Being as you have a newborn there is no way that baby should be going back and forth between households anyways. I was in a similar situation and just for the health of the newborn the doctor wrote a letter for the court stating limited travel and contact with others until the baby was no less than eight weeks old and possibly more depending on the vaccination schedule. I never had to use the letter as the father is a deadbeat😒

Get a lawyer, have someone with you at all meetings/visits. I don't know if he can use this against you, I wouldn't let him take the baby out of your sights.

My brothers ex-girlfriend had physical custody he had visitation rights. Last time he saw the ex was when she dropped him off for a visit, she wanted to cut the visit short and pick him up early and he refused as is his rights. She never came to get the boy, she skipped town and stopped contact with her lawyer as well, although the lawyer creep covered for her for a month or two after this.

Seeing baby is so young the court almost always will want baby with momma. Unless for some reason your proven an "unfit mother" they will want baby with you! When my parents divorced, my little sister never stayed the night at my dads until she was over a year old. Only day visits were allowed. Honestly, I don't blame you though. I wouldn't let my baby go anywhere without me. My lo is 3 months and she still goes everywhere I do. (Plus she's ebf).

Is his house safe? Does he live with his parents? Will there be other trusted adults around? A lot to take into consideration. You know how hard it is to have a newborn, so do you REALLY think he wants to take the baby and keep him/her from you? Take care of the baby 24/7? In my option, most guys would not want that. Especially if this guys is "being an ass", that's a lot of work with a baby just to spite you. I would say let him see the baby at his house, drop the baby off and make sure it's safe and he has all the stuff the baby needs. Set a time for drop off/pick up. Communication is key.

Where I'm from mother automatically has custody until court takes place. I wouldn't let him take the baby. He can visit at your house and if he chooses to be an ass to u then he can't come over
