Then he won't be legally acknowledged as the dad. If he doesn't want to sign don't press the issue; you can still get a paternity test and establish child support.

The baby will not get his last name, and if you ever need to go get child support they will do a DNA test before naming him as the father unless he goes and says it's his baby and no test is needed and he will then sign a paper along with you stating that he is responsible for this child and before signing they will probably ask him if he is sure that he doesn't need a test (personal experience) because after signing the paper he will no longer be able to question paternity.
