I'm older I'm 17 and he's 15 but the way our birthdays fall we are technically not always 2 years apart.

Legally, not yet, but by the time you hit 18, you may have issues due to him still being a "minor" and you an "adult". Legality aside, you may run into stumbling blocks as you both mature simply because women tend to mature mentally faster the men. However, that varies person to person. Allow eat other room to grow, and be mindful of local law when it comes to your sexual intimacy, and you should be fine. :)
