custody advice?

I am 17 with a 9 month old baby boy which I love very much. I am 4 months pregnant by someone else. I am a single mother but the father of my 2nd child is a horrible person. He is telling me he wants full custody of the baby when it's born. I go to school, online, and after I have this baby I will be getting a job & put my babies both in daycare my children are the only things that keep me together and motivate me. He has a job he works 12+ hours a day he has hardly no time for a baby. I'm already a mother & doing it on my own. He has a drug problem and I have too much to lose to do drugs. He has a felony for auto theft but got dropped to misdemeanor. Could anyone share your stores with me. Or tips on how I could get full custody. I realize it's not fair to keep him from the child but I do not want him keeping the baby overnight what so ever. I feel that it's in my child's best interest to be with me & his/her brother. Please help

Nothing will happen without a court order. If you are not married now, he  has no legal rights to the child until paternity is proven. He can demand a paternity test after birth, however, and that you would legally have to comply with. After paternity is established, he could then try for custody. In most states, courts start with the "rebuttable presumption" that unless one parent is a *proven* danger to the child (i.e., there is a criminal record of arrest/charges for violent or sexual offenses, or a documented medical history of substance abuse or mental instability, like hospital admissions for ODs or involuntary commitment for psych evaluations - you can't just "say it" and expect a court to take you at your word, you need actual documented proof), the best interest of the child is served with joint custody. If you are breast feeding, that may convince a court for logistics' sake and the comfort of the infant that he shouldn't have overnights until maybe one year, but even if that is the ruling, it's very likely he would still be awarded parenting time with the child (like 3-hour visits with a newborn, which will expand as the child progresses to toddler stage). Honestly, though, family courts move very slowly and he would need an attorney to make these things happen. If he establishes paternity through testing, he's also opening himself up to being legally on the hook for 18 years of child support. I don't know your situation but I do know from experience working with the family courts, most baby-daddies who threaten to take custody are doing so to try to hurt the mother, not because they actually want the child. And once the long-term financial consequences of pursuing that path become clear, most of them simply disappear.

You're gonna have to go to court for all that. But prepare yourself, judges now a days don't like to do full custody anymore unless you can prove he is unfit.

Only the court can give you full custody and unfortunately if they feel he deserves time you will have to let him have the kid overnight. I highly doubt court will give him full custody. But there's a chance he will get joint or atleast visitation.

You may end up with shared parenting or he'll have visitation or something since judges are hard to convince about getting full custody. But save every text, voice mail, email, fb message, everything just incase something in there helps your case. Also, as long as you don't have any addictions (drugs, alcohol etc.) it'll be hard for him to take your child from you because most judges want the baby to stay with their mother and their sibling. But he completely prepared for a long battle in court unless you two can come to an agreement

Doe she have a court record for his "drug problem" meaning has he been caught. 
You need to keep communication with him to only Text or emails everything In writing! Document document!

It just about every state for the mother to lose her custody you have to be a really shitty mother. Courts tend to favor women. 
I'm sure you'll be ok. You can request supervised visitation.

No ones going to give custody to a convicted criminal with a drug addiction.

Keep any evidence of his addiction, any rude or threatening messages to you.

Don't communicate with him other than in writing. Keep all contact to a minimum . You don't need the stress
