Should parents be prosecuted if...

Should parents be prosecuted if they chose not to seek medical care for their ill child because they chose to seek religious/natural help? For example...If parents neglect to get their daughter help for a life or death illness and they chose to treat it with prayer and natural care and the daughter passes away... What should happen? Keep in mind that the parents genuinely thought they were doing their best in caring.
