Rape case dismissed

I saw this on Facebook and was wondering about everyone's thoughts. A 20 year old man named Arman Premjee was accused of raping a 19 year old fellow school-mate. They met for tacos and drinks off school campus for a date and the women was intoxicated. Afterwards they slept together. Security cameras however, caught them in the bar, the hallway, and outside before they got into a white car and left. The video shows her kissing him in the bar and then taking him by the hand and dragging him out. She is obviously very drunk and staggering, but leading him by the hand nonetheless. He follows her out and she is grabbing him and kissing him in the hallway. When the camera catches them outside, she is standing behind them sticking her finger through her "ok" motioned hand (we all know what that means) joking to her friend about sleeping with him. Then, she brought him to her dorm and signed him in. The case was then dismissed by an LA judge, who said she was in fact the aggressor. She was extremely intoxicated and he was not. But, she did drag him out, lead him to the room, even sign him in, then sleep with him. What do you guys think? Many of you live by the "if you're drunk you can't consent period" rule. But what about this instance? Should he be charged? Was this rape regardless of her being the initiator because she was drunk?
