Should you be able to sue someone that tried to help in an emergency situation but caused further injury?

Question

Ex: if someone gets into a really bad car accident that caused them to be trapped in a burning car, should the person be able to sue you if you decide to help by cutting their seat belt but in the process of dragging them out the car hurt them further (I.e. break their leg) 
Things to consider:
* as of right now, you can sue someone that chooses to get involved 
* does knowing that they can face legal trouble cause more people to be bystanders in emergency situations?
* if you voted no, does your answer still apply in instances where a life was lost due to someone trying to help?
* if you voted yes, would it be morally okay to watch someone die in a burning car if you knew professional help wouldn’t arrive in time

I think you should only be able to sue if it can be proved outright with no shadow of a doubt that the bystander’s actions are the direct cause of death. Otherwise that’s not right.

If someone’s intentions were good and they tried to help, I don’t believe you should be able to sue.  If I was in a car accident and my car was going to go up in flames, and someone got me out of the car but in the process I became paralyzed because of a neck injury, I don’t believe that’s the case for a lawsuit.
Many people don’t stop and help because they know they are liable if someone gets hurt and it’s sad.
We live in such a sue happy world, unfortunately it seems that everyone is always looking to get rich quick.

This is a hard one. I think as long as it isn’t life or death, bystanders should leave rescuing to those who are adequately trained and certified. If it’s life or death and you know help won’t get there in time, then I think bystanders shouldn’t have to worry about being penalized for further injury unless their actions could be reasonably proven to be negligent. Since these are judgment calls (whether the situation is life or death and whether the bystander’s actions were negligent), I would think it would still have to be decided in court.

Yes. You have a right to sue if you feel like you were done reparable harm, so you should be able to. You might not win though.

No. Good Samaritan laws were put in place for a reason. Otherwise people would be too scared to help out in an emergency situation, which would result in more injuries and deaths.

Too often people depend on laws to dictate and set their ethical standards. Sure, sue me if you want to but I WILL try to save your life. Period. If I break your leg, I'm sorry and if you sue me, that's your perogative.

Here in Canada we have the Good Samaritan Law which means you are protected if you try to help in an emergency situation
