"The Case of the Driver and The Ducks" (from Readers Digest "you be the judge" March 2018)

Here's the summary: a woman pulled over on a busy four lane highway when she spotted duckling wandering helplessly on the concrete median. Witnesses say she stopped her car in the left lane without turning on her hazards and leaving the driver side door open. The woman was trying to save the ducks, which she planned to take home. Her vehicle ended up causing an accident in which a father and his 16 year old daughter died on their motorcycle (as people needed to serve to avoid hitting her car). The woman was charged with two counts of criminal negligence causing death and two counts of dangerous driving causing death. She was facing life in prison. The woman apologized and admitted she made a mistake. She stated she didn't see other cars when she stopped so she assumed it was "safe". It should be noted that the motorcycle driver was speeding, which may have contributed to the collision. The woman's attorney argued that the crime was an accident with no criminal intent.

In the end, the woman was found guilty. She received 90 days in jail, three years probations, 240 hours of community service, and lost her license for ten years. The woman appealed, saying losing her license for ten years was extreme, stating the highway safety code requires on a three year loss of license for her crimes. However the court disagreed, upholding her conviction and the ruling, stating the driving ban compensated for her exceptionally lenient jail time given.
