Should other charges have been pressed?

This happened at a daycare by my house. It happened a few years ago, the reason it was brought up again is because my friend was asking about this daycare, wondering if it was a good place for her daughter to go. 
My personal opinion is, HOW DO YOU NOT KNOW THERE IS A CHILD UNDER A CHILD SIZED BEAN BAG CHAIR YOU'RE SITTING IN!?!? I don't know about your kids, but mine would've been screaming. She should've heard him. And like the mother said, how do you lose track of a child like that? 
I've heard many things about this day care such as:
•The owner is lazy.
•They don't change diapers as often as needed.
•They don't watch the kids playing on the playground outside. (It's fenced in but by a very busy road) 
This daycare is still up and running-- even after an incident like this. There were charges pressed against anyone worth mentioning. 
What are your thoughts? 
Should there have been harsher charges pressed against the employee, the owner? Should the day care have been closed down. Do think this was an accident?? 
If this happened to you would you be happy with just an "exchange of money" I would've had that place closed down, there would've been chaos of that happened to my child. A "conditional" license wouldn't be good enough for me.

I would've burned it to the ground. My child is my life, no way in hell would money ever be enough. Charge everyone involved.

I wanna day no it was an accident but I still it was very negligent. 
How did they not notice the child missing? How often are they counting the children to make sure they have everyone?
I have this odd habit of lifting things when I’m around kids just to make sure they can’t get stuck or if nothing potentially dangerous is hiding about. But I can’t expect everyone to think like me so idk. 
Idk if I’d sue. This would be an incident I’d take a step back from to access everything and then go from there.

It was story time - a perfect time to make sure all the kids are rounded up and accounted for. How did this happen? How did they not notice one of the kids was missing?

I’m sure it was an accident, but it was a tragic accident that should have never happened. I want to know how that teacher didn’t realize there was a child under the beanbag chair...I don’t understand how she wouldn’t have heard him or felt him under the chair. He must’ve been moving and trying to get out once she sat down and I don’t get how she didn’t feel that. 
I’m sure she didn’t do it on purpose, but the fact is, she, as well as the other employees, were negligent and a baby lost his life. If I were the boys parents, I’d definitely sue for as much as I could get. It would help pay for funeral costs as well as allow myself to take time off of work while I process what happened and grieve in peace. Those parents are already going through enough right now, they shouldn’t have to worry about making it to work to pay bills and keep food on the table as well. 
I also think the daycare should either be shut down, or at least have an extensive investigation conducted.

This place should have been shut down, and the owner and employee changed.  I curious what the cameras showed.  I used to work at a daycare and for a child about to turn two, there should’ve only been five children in the room with one employee.  Or 10 children in the room with two employees.   There is absolutely no way this should have happened.  5 kids isn’t that many to keep track of, how do you not notice 1 is missing for over 20 minutes?? And then sit on them yet.  Was she new to the job? Or maybe she wasn’t the regular teacher for that room? I don’t know, that’s a long time not to head count.  You have to head count constantly.

I work in a daycare myself, there are certain ratios that need to be met. For where i live its 15 kids to 1 staff for older kids, for younger its 10-1 and then for toddlers and babies its 5-1. Personally its a rediculous ratio, as a worker i can honestly and openly say it is impossible to keep your eyes on every single child at every second with ratios that high. If you have 25 kids in a room its even harder, especially when not all staff do their jobs properly. I could see how something like this could happen. Now i still think its NOT okay to not realize a child is "missing" i am constantly counting and checking our attendance boards to make sure i have all kids, so if one is missing i can recognize it FAST and act accordingly. I do think it was an accident that she sat on the chair and the child died. But they should have their daycare license revoked for improper supervision. I dont believe they should be necessarily charged but i do think there should be consequences within daycare licensing

How did they not notice they were down a child for 20 minutes? I am a counter, when I lifegauded, taught early childhood, and even now as a special ed teacher. I was and am constantly counting! So for obsessive me that is the part I find baffling. That is so scary.

Everyone should be charged. This is pure negligence...absolutely disgusting and devastating.
