Can my husband adopt my daughter?

I just remarried to an amazing guy whom I’ve been with for a long time. He loves me and my daughter and we love him. My daughters father hasn’t been a part of her life at all. Unfortunately he is on the birth certificate. Can my husband still adopt her and have her last name changed?

He can, but the father will have to consent to the name change and will have to sign his parental rights away before she can be adopted

Laws and procedures are different depending on where you live, but typically you have to get the permission from bio dad. It that's not an option, you have to petition the courts to terminate his parental rights first. If granted, you would then file a motion and have your husband adopt her.
