Fishy or not: should I confront him?

Question

Last night I fell asleep early like 8 PM, I think and I woke up at 10 PM and my boyfriend wasn't sleep in next to me. So naturally, I woke up and went to look for him (he was sleeping next to me, before I went to sleep). Anyways, I found him in the bathroom and he jumped. He was like you scared me.... He had one hand between his legs and his phone out. First, a rant. How can I scare him when we are the only two people living in this apartment together? Second, I should go through his phone, but I'm not like that. And third, should I ask him what he was doing? I went to bed acting like I didn't see anything, but then he messages me a photo of him on the toilet and a message saying he's fat like right after that and comes to bed 5 minutes after. 
Maybe I'm just over thinking, but help, please! We've been together for over 3 years and I'm so lost.
Update: found out it was to an ex's video/photos lol fml. It's still okay? Obviously, yall can tell it's my first serious relationship lol.

You are way overreacting.
He was probably scared because he thought you were still in bed and didn’t hear you.
Second, he was probably taking a dump and reading stuff on his phone.

Dump him. He should’ve gotten rid of those things from his phone ages ago, and if he’s getting off to an ex he isn’t 100% faithful to you.

If I walked in and my husband was on the toilet with his phone out I would immediately assume he was reading Reddit while taking a poop. If he were just standing in the bathroom with his pants down and his phone out I would assume he was jerking off to porn. I personally wouldn't be thrilled with the porn answer but I would accept it. 
As for you scaring him: my husband scares me a lot and it's just us and the kids in the house. I won't hear him walking into the room and I'll just glance up and see something or I'll just randomly hear a noise behind me or whatever and it startles me. It isn't a lasting fear but it is a quick startle and a "oh you scared me. Its just you. I hope I didn't wake you."
I think maybe you should talk to him because I'm sure there is a simple innocent explanation and I think you'll feel better after you hear it from him. Just don't start the conversation as an accusation or something and it should go just fine.

Literally my SO has done the same thing to me and me to him.. when you dont think someone is going to walk in the room and you think you are alone.. you get really scared... I've been in the bathtub and he walked in slowly and I have literally threw my body because I was so scared
