yes. age of consent here is 18. we don't have a romeo and juliet law either. the 19 year old committed statutory rape. also there's no longer a statute of limitations for rape in california. it would be considered a wobbler case as the perpetrator wasn't 21 but still 3 years older and the victim (minors cannot legally consent) was 16. so if they decided to press charges the 19 year old could be charged with either a misdemeanour or a felony depending on the prosecutor.
