Does this woman deserve to get her child taken from her and the biological dad get full custody? Read below

A woman knew her boyfriend wasn’t the dad of this child for 4 years. She actually knew who the dad was but told him that he wasn’t just because she didn’t want him to be . He gets a dna test and he’s indeed the dad. She knowingly cheated him out of 4 years of being a father. He’s going to take her to court to see if he can get custody. He has his own home, college educated, no priors, doesn’t drink or smoke and he’s been at his job for over 10 years. Meanwhile mom is staying place to place now because her boyfriend left her because she lied to him. She hasn’t had a job in years and smokes weed and pops Ecstasy￼ pills. Will the judge grant him custody or at least rights to the child

At minimum, the father will get rights (obviously). He’ll get visitation for sure. But they won’t just rip a 4yo child away from its mother... that would be cruel to the child. If it’s proven she’s unfit, she will indeed have to jump through hoops with CPS, but their goal is to unite families, not rip them apart.

I don't know but he seems to have the much more stable home. Unfortunately, it will be difficult for the child either way. Unstable homelessness with a pill popper or a stable home with a stranger.

You’re asking 2 different questions for the poll.  Does she deserve to have her child taken away and will the judge grant the father custody or visitation. I definitely think the judge will grant visitation, possibly custody depending on her situation when it’s time to go to court.  I agree with previous response, either way the child’s life is going to suffer.  They just lost the person they thought was the father and mother doesn’t seem to be doing well. Sounds like a sad situation all around.

He will recieve entitlement to visitation and partial custody if he wants it. 
No, there is no court in the land that will remove the child from its mother to hand them over to a parent they have never met. Courts do not use children as pawns. I.e...mom did the morally wrong thing so we will punish her by taking said child. It dosent work that way.
The only way a child would ever be taken from mom is if the mother is incredibly unfit. Proof of this would be multiple run ins with the law, proven drug use that endangered the child, proven abuse to the child...and even then...
There is a romantic notion that CPS and the system can solve all ails and can put the pendulum back in swing so to speak, but it dosent work that way. The system is overburdened and can be corrupt. I've seen far too many children be awarded back to clearly incompetent or abusive parents and then die simply because of equity. Practically every atrocity involving a child neglected to death, beaten to death, starved to death has a laundry list of CPS/court involvement attached to it.

No the child doesn’t deserve to get ripped from it’s mom and given to a stranger, even if it is their father they’re still considered a stranger as of now. Also she probably lied because she didn’t want her kid taken away, no it’s not right but it was her logic. 
But yes the court will do some type of custodial agreement with bio dad.

I don’t think any mother deserves to get their child taken away from them unless they’re abusing them but seeing the circumstances it does seem that the judge would be in the fathers favour.
