Husbands prior children's last name???

Question

My SO and I have finally came to a agreement on our last name issue.

He will be changing his last name to mine. Now as for his kids, who are from a prior marriage, have his maiden last name.

Could she change their last names to her maiden name or future married name in court because he changed his last name  ?!??

If he's changing his name I honestly don't see how he could be upset about possibly changing theirs. To each their own but I just don't understand why he's changing his name or why it's even an issue?

If he has kids who share his last name, it's in THEIR best interest for him to just keep his own last name. Why put his kids in such an awkward position? Maybe you should just keep your maiden name, or hyphenate? Seems so much simpler to me.

I'm not an expert on the topic but I am pretty sure him changing his last name has no affect on the kids. It may make the baby momma feel more strongly about changing her kids last name though. If he has partial custody, he should have to sign for a name change.

The children's last names are already legally set on their birth certificate. If he wants to change his last name (which anyone in any state can do). It will legally have no effect on their last names. When you take the children for summer vacations or breaks your husband will need a copy of their birth certificate with his Madien (there has to be a male version of this word) name on it, as well as a copy of his name change. Most likely your marriage certificate, but he may also have a legal name change document not related to your marriage certificate.

If the birth mother wants to change the kids last name. This is a seperate name changing Incodent then the fathers. She will most likely need a signed document from the father, which he should be very open and willing to give. I believe there's a way around that legally but I don't remember that process. Since he sounds like he is still a big part of their lives this should be easy. I'm not sure how old the kids are but if they are school aged and social (6 +) you may want to let them make the decision since name is tied to their identity, particularly in school. Depending on the relationship this could be a great teachable moment.

Hopefully this helps. If this situation was reversed and he was a woman this would be the process. It's more common then you think. My family went through something similar when I was a kid, and I decided to keep my birth certificate name. (I was around 11) .

Some of the comments I see are caught up in the fact that he is male. But in the eyes of the law and name changing it does not matter. You might need a few extra peices of paperwork when they travel with you or when enrolling them in daycare/school , but it really is not that big of a deal.

Ah, thank you! I have been trying to remember what they are called for so long! That's great that your friends dads did that, it would be a shame for the names to die out. My husband doesn't want to change his name because it's too much hassle but he thinks it will be good for our children to have my name.

When a friend of mine wanted to change her son's name she had to go to court because the "father" refused to sign the papers. She got her way in the end.
