Can I just add- if he was thinking he would Join the military and then try to win custody being in the military won't help. That's a profession where he would be over seas for extended deployments and also training. It wouldn't be an ideal situation to take on a child full time (obviously if he has  a new stable relationship that would be different)

My husbands in the military. It would give him no upper hand in terms of custody. But perks and support for military family's are amazing (health care, domestic leave, housing and general stability)- so maybe he means better in this regard.

Your son's father would be gone all the time. I think it would be easier for you to take care of him because your husband would be gone here and there. 
My husband is in the military and if we were separated the kids would stay with me because then the child wouldn't be moving from place to place and I would be able to watch him all the time.

No, he cannot take custody.  
If he is joining to make a better life for you and your son the I would say that's a blessing. 
He sounds mature and very selfless. 
There are perks to the military but due to the deployments and change in duty stations there is no possible way he would be able to take your son away or get full custody. It's not possible and would not be a healthy environment for the child.

Absolutely not! I had to get OUT of the military because my husband and I were dual military and we didn't have anyone we trusted to care for our child in case we deploy.

My ex husband is in the navy and he wasn't allowed custody of our daughter bc of it. Unless there is a reason for the court to deem the mother unfit or unstable it is always in moms favor or joint custody. It just depends on the situation. Our neighbor is a single father and has full custody of both of his daughters due to their mother cheating on him while overseas.
