Custody Battle

Kind of confusing so bare with me.

March my husband served his ex with custody papers for their 2 Kids. Just saying he wants everything 50/50 and he wanted them on weekends. I recorded us giving her the papers because she's a Liar and vindictive. Well that was March 22 come March 28 she Filed a dvp saying he abused her and the kids and had him arrested on March 30 stating in the DVP she has no knowledge of a custody case. He hasn't seen or talked to his kids since, daughter is 3 and son is 8 Months old. We have Court in November based on the custody because she's saying he's violent and doesn't want him around the kids and asking she get 100% on everything but my husband has to pay for everything including whatever sports she decides to put them in on top of his child support. They were together for 8 Years and she never called the cops on him it was always him calling on her for beating him and trying to steal his car. We have all the paperwork showing where he filed first and she retaliated by claiming domestic violence and text messages where he was a good father when he was giving her money but when he said no he was a piece of Crap and didn't deserve the kids so he wasn't allowed to see them and saying if he didn't do what she wanted they could do it the easy way or hard way and that she doesn't care what a judge says he's never getting the kids. Will the judge actually look at all the evidence or only care about the open case of domestic assault against him (filed after custody papers and still haven't been to court over because they're waiting until March of next year to drop the charges, after a year they can't do anything anymore)? She has legal aid and we've been trying to save money for a lawyer but with me being pregnant and us spending money going back and forth to the court house filing papers trying to undo what she's done it doesn't look like we'll have the $2,000 by the court date. What are the chances of her possibly getting her way?

I know you guys can't actually tell me but just a guess because it breaks my heart seeing him cry over his babies and I really don't wanna get my hopes up let alone his. In my state if you lose custody to one child you lose custody to all the children you have before and after.
