RAPE AND CONSENT: A guy asking a drunk girl for sex?

Society seems to treat us different. So let's discuss this.

Is it RAPE: If she's drunk and he doesn't ask...is it really consent? Because technically she's isn't in the state of mind to make the right decision but male society seems to think that not saying no is also a yes. They also seem to think that saying yes to sex while drunk is the right thing to do! What is it? Where is the line drawn? Because I would consider that today's form of rape..drugging a girl or a drugged girl should be included in that category. I believe it's just a painful and hurtful as forced rape. But let's talk ladies!

If both parties are drunk and want to have sex then it's ok but if there's pressure or force on either side it's rape. Being drunk means you can't really consent, if someone who isn't drunk has sex with you it's taking advantage of you. Just my opinion

I think if your intoxicated when your with your partner that's a different story. But if your drunk at a party and are intoxicated to the point where you won't remember or can't properly give consent. It's rape.

Anytime someone is taking advantage of the situation, or someone is clearly too far gone to know what's going on, like the scenarios you were describing, then yes it's absolutely rape, and in the eyes of the law it's always rape, but if both people are drunk doesnt that mean they raped eachother? It starts to fall apart. The law is written that way to protect people, and that's fine, but I don't think it's as black and white as saying all drunk sex is rape. I've had drunk sex that was completely consensual, and so have millions of other drunk people, both couples and strangers.

When a person (guy or girl) is drunk then they legally cannot consent. So yes it is legally considered rape. If both parties are too drunk to consent then that's were things get a bit murky. But if someone is till capable of driving a car and you sleep with a drunk person without prior consent then that's rape.

The reason a couple can have sex drunk is because of prior consent. And by prior consent I mean consenting to having sex before drinking not because you said yes to sex yesterday or last week. Most couples don't actually get prior consent every time they've been drinking so technically it could still be considered rape. But depending on circumstances that case would be dropped.

I've had this explained to me by a doctor specifically trained to deal with victims of rape. I lost my virginity when drunk and since my boyfriend at the time hadn't been drinking it was considered rape. Especially since he knew I wanted to wait for marriage. I did say yes at the time- but I was drunk and could not consent. I spent a lot of time pretending I was ok with it. I stayed with the guy and kept sleeping with him. Then after leaving him and getting into a new relationship I started having panic attacks during sex. And ended up seeing a doctor and finally had to deal with what happened.

You cannot consent when drunk. People really need to understand that.

Idk this one always gets me bc I mean understand that you cannot make right decisions when drunk, but then again how many of the girls on this app have talked about having "great" drunk sex, how many times do you hear a girl talking about a one night stand that she had sex with while drunk? 
People don't see drunk sex as a bad thing. 
People think it's okay to have sex while drunk, I'm not saying it isn't, and a very little amount of people are aware of the dangers of drunk sex.

There are dangers of drunk sex, like not being aware and etc, but people still do it and most of the time they're okay.

I've never been drunk, I've never drank so maybe my opinion is wrong but I think that even when you're drunk, you know what you want and what you don't want. 
Just because you regret that one night stand, doesn't mean you were raped. 
Unless you were forced, pressured, etc, I don't think you should really be claiming rape.

If you ask and it is a yes then it's a yes. But you ask and it is even hesitant, it should be dropped. Every situation is different and it depends on what happened. But If she or he is black out drunk then it shouldn't happen at all
