i was just wondering if anybody had an idea if my 5 year old he weighs 42lbs and is 38in if he still needs to use a 5 point harness or can he use the regular seatbelt

Depends on the weight limit of the seat. He may be able to do either the harness or the high back with seatbelt since most seats have overlap on their height/weight limits. If that's the case, keep him in the harness as long as possible because it is safer.

Also, check your state booster seat laws. Some states don't allow 5 year olds to be without a booster regardless of height and weight.

It depends on what height and weight is the limit for the carseat you are currently using. If he's outgrown it you should be able to find another seat that will work for him to 4'9" and 8-12 years old. The bare minimum for getting out of the 5 point type is 5 years old and at least 40 lbs.

He definitely still needs at least a booster seat. Maybe try looking up height and weight guidelines for car seats in your area? It would give you a better idea of what is needed still.
