Who did it? Mother suing hospital for death of baby.

I got this off global news and thought it'd be a good debate. From what I read I say hospital. She was on painkillers, and other drugs and they never seemed to check up on the baby.

So, who's at fault and why? DISCUSS

Hospitals fault. Nurses know to ALWAYS keep medicated mothers under supervision. It would be a different story if the mother was already awake and alert when the baby was handed over, but obviously that is not the case. I've also never heard of a nurse just handing over a baby and walking out. She deserved accountability.

I was just reading about this and I feel like we are only hearing one side of the story... I'd be interested in hearing what the nurse has to say about what happened. Not all nurses and hospitals are the same but I've given birth 3 times and the nurses had NEVER just handed me my baby and left without making sure I was fully capable and comfortable with taking care of them-especially while on certain meds. I feel horrible for this mother and it's truly a tragedy but maybe shes looking for someone to blame out of grief. I could be totally wrong and the hospital is at fault but I feel like not enough facts are known here.

God what a horrible situation to be in. Totally the hospital's fault. The poor women needs compensation for her medical bills and lost wages at the very least.

Both. They both should have stopped it. The mom could have requested to not bed share knowing the risks but the hospital should have also monitored better.

Id say both, theres just some people who cant take medication like that. The lady should have told the nurse she was too tired, but then again he nurse should have seen she was exhausted. The hospital can only do so much, so if she said it was fine, than i blame the mother.

How long did no one check on them? When I was breastfeeding in the hospital they checked on me every 15-30 minutes. That's long enough to suffocate at newborn. I think it was no ones fault. But if it was anyone's fault, I'd say the mothers. 
Unless the nurse was aware she was on medication that could cause her to be like that. But I was on pain killers after birth and I was fully awake and aware. But in the end, I don't believe it was anyone's fault. Just a tragic accident. She has to live with knowing she killed her child. I couldn't imagine that.

I'd say it's a little of both. I've had two kids, and I never had nurses constantly checking in on me. They'd come in here or there to ask if I needed anything, to get vitals or if I called them. I'd say it's the fault of the hospital for (presumably) being understaffed which I assume is why a nurse wasn't immediately able to respond (at least, I hope, and they weren't being intentionally negelectful). I'd also say it's a little bit of her fault because she should have known better than to try and feed her child breastmilk after taking a sleeping aid, not only because she could fall asleep, but because it could effect the child as well. I myself was recently going to get a muscle relaxer at 4 weeks PP due to debilitating muscle spasms, but didn't because my doctor said that breastfeeding while taking a sedative could effect my baby. Then again though, we don't have the hospitals side of the story and thankfully they have to record a lot of things (which will prove who was at fault). In the end though, it was a horrible situation and no amount of money will ever be able to bring that poor baby back.

It's a complete tragic accident and the nurse should have been more aware. It happened over 5 years so I'm willing to bet policies have changed pretty quickly at that hospital and it will never happen again. The baby was 4 days old and still in the hospital so wondering what other info we don't know about it. We also don't know what the nurse was doing a 3am shift she could have been napping or handling another patient issue that came up. Sadly staffing at hospital is where negligence occurs. My daughter had a birth injury and the root cause was new nurse and busy labor unit.
