can I leave state with my child?

so I'm young and 20 weeks pregnant. I recently decide to leave my boyfriend who is a low life and likes to mentally abuse me, since I've been pregnant he stopped being physical. he says he will take my baby away from me. I'm not giving the baby his last name ( which he says the courts will change it to his last name ) and I'm thinking about leaving state nowish In fear he will take me to court, I do want him there when our child is born and around sometimes just not all the time and I don't want him to have any custody and if i had to go to court over custody id be terrified at the idea of losing my child even if there is a 1% chance he could win, I don't like it. can I leave state with my child legally?

Currently there's nothing he can do over you leaving since you're pregnant. However once the baby is born and he decides to take you to court if the court doesn't rule that he's abusive he will get partial custody over your child

Look into an Order of Protection. Since he's been abusive in the past, it shouldn't be too hard to get one if you truly believe he will be abusive in the present or future. This will also help you if he does take you to court for custody, even if you do flee the state. It shows your know he's a danger and you've doing what you can to protect yourself and your unborn child. Also see what sort of legal aid might be available to you in your area.

Start documenting the abuse. If you’ve told friends or co workers about his abuse. Picture etc take it all to the cops so you can use that against him if he takes you to court. They can’t force you to change the babies last name. They also can’t make you move back in the same state as him so move now while you can girly. I don’t think he will even take you to court but it’s always good to be prepared

I think you should start saving evidence. If he tried to take you to court you can have proof he would be unfit to have custody. I think you need to get out of that situation, not only for you but your baby as well. I'm so sorry you are in this situation. I hope it all works out, good luck!

You can do whatever you want. You have sole custody of your child automatically because you are not married. You can give your child whatever name you want as well. You can make up a last name and no one can tell you you have to change it. I agree with not not putting any name for father.

i personally would send him a text about how u feel when he hits you. or ask him why he hits you. just for proof after he responds. then id email it to myself so Id never lose it. 😊 then because the baby isnt here and there is no court order I would leave and change my number. possibly only communicate with him via email. but b sure your mind is made up. no need to go through all these changes if hes able to cry and beg and you come rt back. wasting everyone's time including your own.... then Id start all over with new goals and enjoy the rest of my pregnancy in peace while getting counseling.

I hope you filed reports of the physical abuse. If not, do you have pictures of marks he's left on you? Does he have a criminal background? If no, I think you'll have a hard time fighting it in court. Good luck.

Leave the state, or at least get yourself into a safe place, and consider getting a restraining order on him. When the baby is born, don’t put anyone in as the father, and don’t allow him to fill out or sign a recognition of parentage form.
As parents, we have a solemn duty to protect our children from danger. Sometimes that danger is the other parent. We have to be prepared to take some heat if necessary to ensure that our children are not mentally or physically harmed. 
That’s my serious advice. At this moment, my sister is going through absolute hell with her older daughter’s biological father, and it would have been much better if he’d never been named as the father in the first place. Some people are not safe to be around, whether they’re capable of shooting out sperm or not. Trust your gut.
