Do the parents have a case?

I saw this on the news and was curious as to what people's thoughts are as far as them filing a police report and taking legal action. They claim the conductor didn't check the seat belt and therefore it's the fairs fault that the child was hurt. However, I sort of think it's also the parents fault. Why didn't they notice and point out frantically that his seat belt wasn't checked?

I think it's the parents fault all the way. They obviously know their child and how they behave. They knew that their child wasn't going to sit the whole time, so one of the parents should have rode with him, or not let him ride rides by himself. If your child don't understand to sit down the whole time while on a ride then they shouldn't be on it with out a parent. Also if the child could stand up multiple times, the dad obviously didn't tighten the seat belt they way he should have.

Parents fault completely, I've never known anyone to let a child of that age ride without a parent on this sort of ride. Maybe the fair should have an "all children below a certain height and age to be accompanied by an adult" rule,

Parents fault, if your child stands up after you buckle him in then you should remove your child not assume the park attendant will have more/better control over your child than you as the parent!

It’s really unfortunate but this is the fault of the parents. They should’ve rode with the boy or reconsidered.

I don’t understand how it’s the parents’ fault. The workers didn’t check the belt like they were supposed to, I don’t see how it can be anyone’s fault but theirs. Can someone please explain to me how it’s the parents’? I’m genuinely asking.

First of all of my child can’t sit in anything that moves without getting up they ride no rides. I would know this prior to my kid getting on a ride.
If they even looked like they were gonna get up I’d yell “hey make sure you sit on your butt please”
If all else fails and my child did something like that then we going home. 
Plus it’s not like he was on a damn roller coaster.

I'm sure they have a case. People always find others to blame besides themselves, and win cases like this. Regardless if they meet the height requirement, I would never let a 2 year old on a ride on anything by themselves. I think it's the parents fault for sure.

I hit yes but I honestly believe it was the parents fault. The dad was buckling the child in and clearly didn’t care enough to make sure it was tight enough to hold. There’s also a possibility that the attendant checked and everything was fine and the child still managed to shimmy himself out of the straps. If the child wasn’t mature/well behaved (depending on how you look at it) enough to be trusted to sit still the parents shouldn’t have allowed him on the ride. Just glad he’s ok.

So the dad didn't buckle him in? Some parks won't let the ride attendant buckle it has to be a parent accepting the responsibility.
