The doctor at the ER and me got into a argument. She tried to tell me I was only 2-3 weeks and I told her well technically yes but you start at the first day of your last period and that would make me almost 5 weeks and she kept telling me I was wrong. I get what she meant but she didn’t want to understand what I was saying... what do you go by??

Technically you count from the first day of your last, but the baby its self would be 2 weeks younger so both of you are right. Your 5 weeks from the first day of your period but your baby is only 2 or 3 weeks old.
