Is this legal?!

My daughters father got physical with me last night and ended up in jail with a 72 hour no contact with me. Hes texting my brother telling him that he’s going to call the police if I don’t let him see her and stuff and get her taken from me. Is that seriously a thing? I would think it would count for her too and that they would side with me, right?

Lmao. He’s delusional. No. That’s not a thing. He was violent with you and is on a NO contact order. He can’t contact you directly or indirectly. Unless the order specifies, you are under no obligation whatsoever to let him see her. Even if he tried, no one would let that child go with a violent man during this time.

I would get an attroney and find out about an emergency restraining order. However if there is no court ordered parenting contract he can’t force you to see the baby. If there is then he can get police to go with and him you have to give her up if it’s his time but I wouldn’t worry.

Yeah of course he can take you to court and TRY to get her taken but he has to prove you unfit and 100 other things before all that. But no he can’t just call up the police and say make her give me my daughter.

Go to the court house on Monday and get an emergency no contact order on both of you and bring proof that he was arrested and not allowed to contact you. Just to cover both of you so you don't have to worry about it. You can also call the police station and talk to them about it.
