Paternity leave issues?!

So I’m 34 weeks pregnant and my boyfriend is trying to get paternity leave.  He’s been working for his company since October of 2018, so not a year yet.  His boss has been telling him that all he has to do is call HR and get the leave info, so that’s what he did.  Now HR is saying that he doesn’t qualify at all, even for an unpaid leave-because he hasn’t worked there for a year.  My boyfriend tried to ask if he takes more shifts if they’d let him, and they said no.  Is there anyway he can get any kind of paternity leave from the state or even fight this? I’m going to be a first time mom and have no one at all to help me besides him.

Generally if you’re not there for a year, you don’t qualify for maternity/paternity leave. Does he have sick time or vacation time he can use? That’s what my brother did. He saved up his 2 weeks of vacation and 1 week of sick time after his baby was born.

Nope doesn’t matter if he works 24/7 for the next 6 weeks he hasn’t been there long enough and I’m kinda surprised they would let him take it when you guys arnt married... he can still request time off but if he asked for a lot it will definitely go on record and make him look bad

His only option will be to take some sick days. Hopefully his boss will be understanding, but his job is NOT protected if they are not okay with him calling in for a few days. That’s unfortunately the way it works.

No.  It doesnt work like that. You need to be there for a year to qualify.  Maybe he can take some sick days?

No. The fmla law states you have to be working for a company for one year.  If he hasn’t been there a year, there’s nothing he can do but save his vacation time and see if he can use it once your baby is born. I just had my first in February and my husband was able to take 3 weeks of vacation because he had been saving up his days during my pregnancy.  He could have taken fmla I guess, but it’s not paid and one of us needed to be bringing home money.

Theres not really much he can do at this point. Im a ftm and i dont even qualify for paid maternity leave. What he can do is use his sick and vacation days and maybe work a deal up with his boss. My SO is gonna use his sick and vacation time and his boss gave him permission to miss a week since he doesnt qualify either.

Have you looked into FMLA? This may not work either but it’s worth looking into. FMLA for employers typically requires either a year of employment or 1,250 hours worked within the last 12 months. Mathematically this means he’d have to of worked at least 31 full time 40 hour weeks, and I’m afraid if he’s only been employed since October then the odds aren’t in his favor. This means that unless he has PTO (paid time off) or vacation days saved up to take once baby’s born, he won’t be able to take any time off work or else he risks losing his job. Paternity leave is essentially a nonexistent thing nowadays in the US sadly, assuming that’s where you’re from😞

Unfortunately his only option is to take vacation/sick/personal days.  You can’t fight anything because what they are saying is correct.  He’s been at an employer for less than a year so you cant really expect much.  I’m in the same boat my family lives in another state, my husband is a police officer and doesn’t get paternity leave nor can we afford FMLA unpaid.  He’s doing a week of vacation and then scattered time off.  You can and will get through this!
