Unemployment vs Disability in California
I have a couple of questions and was wondering if anyone here would be able to help.
So I was laid off from my job mid March due to Covid-19. I immediately applied for unemployment and have been receiving those benefits since. I have also been in contact with the HR department from that employer asking if they will open soon and letting them know I am still able to work. I just found out they have reopened this week but following CDC guidelines regarding the 6ft apart so in my department we were 5 employees in 1 room before, now I found out they have only 1 employee in that department.
My question is, since the company has reopened but I haven’t been called back to work it means I remain unemployed correct?
Question 2
Since I am still receiving unemployment benefits and I’m 38 weeks pregnant, should I stop my unemployment benefits and file a disability claim or may I stay in unemployment?
This part is confusing because every time I certify my benefits one of the questions is if I am physically able to perform a job, but while I am in labor I won’t be able to, so I’m kind of at a loss here.
Question 3
My plan was to work until 39 weeks but Covid-19 changed that. If I file for disability, will I also be able to get the extra 8 weeks of paid family leave benefits that California is now offering, considering I do not have a job? Or once the 6 weeks of disability are over should I go back to unemployment?
I would really appreciate if anyone can help me out with all this. I just don’t want to get fucked later for getting the wrong benefits and having to pay back money.
