When does ovulation occur?

So got the first test that was just positive yesterday at 4pm. It was a close call so tested again today at 9 am and got the second test. Hubby isn’t home until 8 tonight and last time we had sex was Friday night. Do I stand a chance if we bd tonight? Is ovulation based on first positive or on peak?
