Trigger warning for infant death and car crash.

I saw on the news that a three week old baby was killed in a two car crash the other day. The three week old baby was sitting in the mothers lap in the front, passengers side seat of the car. There was another baby in the car, a four month old, who was in the back, fastened into a car seat. He survived with minor injuries. There was another car seat in the backseat, but no reports on why the infant was not in the car seat.

Should anyone face charges for this? If so, who? The mother, the driver, or both?
