Always. Relationships can go sour and then it's a big fucking mess with the children stuck in the middle. It's only fair to protect the children as much as possible by both parents and that includes from the parents themselves.

If it isnt amicable, yes. Otherwise the other parent can not return the child, not much law enforcement can do, and now theres a big mess. If it's super amicable coparenting, then it may not be needed.
