FMLA paper work??

anyone good at comprehending FMLA , my doctor refuses to allow me and my spouse the 12 week period for FMLA medical certification she said she is only going to sign 6 weeks??? But what I’m reading is we are entitled to up to 12. She has no reason for this… other than she says she releases all women at 6 to resume normal activities?? We’re in Texas

I’m confused 🤔. The 12 week FMLA isn’t usually something your doctor needs to approve for. They only signing that you’re pregnant and need the time off and when you can return to work but your job allows 12 weeks for that time as well as some time to care for your baby, I mean that’s how I always understood it. Doctors pretty much say you can return to work after 6-8 weeks depending if the birth is natural or c section and everything went well no complications.

Disability is 6 weeks. fmla is just your job protection through the company.  I guess your company will only protect your job for up to 12 weeks.  So 6 weeks disability and if you wanted to take up to 12 the last 6 weeks would be a leave of absence unpaid.  
I'm in Texas also I thought fmla was 12 months not 12 weeks maybe that's just my company though.

So basically FMLA is broken up into two parts: 
Medical: 6 weeks for vaginal birth & 8 weeks for C-Section which is what your doctor is in charge of signing off for. They also need to give you a release to go back to work following the medical leave portion (my HR gal recommended getting this at the first post birth appointment) 
Bonding Leave: this will be the remaining duration of the typical 12-16 week leave time.
You’ll essentially be applying for two different forms of leave. One you apply for BEFORE baby is born (medical) and the bonding portion you apply for after baby is born (as you have to provide a birth certificate at this time). 
I’m based in WA but have been dealing with the same confusion until this one HR gal at my work saved my freaking life by actually having this knowledge.

Your physician is releasing you back to work at 6 weeks. However if you meet the eligibility requirements for FMLA you can still receive the full 12 weeks per FMLA guidelines. You will need to speak to your employer and inform them that you will be taking the full 12 weeks. Keep in mind your employer is not obligated to pay you for the duration of your maternity leave. In order for your spouse to receive FMLA he would also have to meet the requirements as well and most likely have to provide proof of birth and and inform employer that he plans on taking 12 weeks.
