Discrimination.?

So I work at a warehouse and I’m constantly lifting big heavy boxes all day. I’m 8w2d and my doctor put me on a 20lb restriction today. I took it to hr and they said my doctor is gonna have to fill out a questionnaire before they can approve my restrictions because they don’t accept doctors notes(I’ve never in my life heard of that),and if they can’t accommodate my restrictions I am gonna have to resign because it’s peak season and I don’t have enough leave time accumulated/I have been there under 90days about 63 days to be exact. I literally just left in tears because I’m saving to pay for my midwife and I’m trying so hard. Is this discrimination.?

I don’t think so, especially if you can’t do the job you were hired for. Plus, you haven’t been employed there very long

Not discrimination. They have policies that they follow. Being that you’ve only been there a couple months you’re not protected by FMLA. If you can’t perform the job duties, they do not have to keep you.

Depends, if the company policy is to require the paperwork then it is not discrimination. If there is no policy requiring it then it is discrimination that they are picking and choosing who they require the paperwork from I would ask HR where the company states that this questionnaire is required. If they cannot show you that then yes it is discrimination.

As promised, An update:
I am able to keep my job .!!!!! I’m going to a different department. I’m not sure why she would suggest resigning but it wasn’t right said by the senior HR specialist. I forgive her because she is new too and everybody is entitled to making mistakes. I was stressed for a few days because life is hard enough as it is on its own. Ladies speak up for yourself and know your rights. If it’s discrimination that they won’t hire you because you’re pregnant it’s discrimination to be fired for being pregnant and needing lighter duty restrictions. Jobs must accommodate you just as they would a disabled person. All is well. Thank you all for insights

I work at TJ maxx and the way they worked things out with me was, they gave me a paper for the doctor to fill out. I bought it back to them, they accommodate me, i was not allowed to carry more than 30lbs. If anything I would ask for help. Now that im farther along (26 weeks) I can only carry 20 lbs, I’m on light duty as of now until I go on maternity leave. I think they are kind of discriminating you. They can definitely work something out with you, at least put you on light duty? Or there’s no area at your job that there’s only 20 less???? 
Don’t resign at all. Worst case they fired you, you can sue their ass just because they want you to carry heavy packages mandatory.

You said peak season. Do you work at Amazon? If so. They are lying to you. That is not at all true. They do accept doctors notes. You need to contact the ERC or an Accomidations counselor. They will help you better than HR. Do NOT LISTEN TO HR. If anything they can accommodate you by having you clean. But they DO accept doctors notes. I work at PHL6 in Carlisle PA. My friend os 7 months pregnant and she still TDR. That's the only thing she does. Do t let them play you girl.

Just to be clear on OP:
I am not trying to go on leave.! I never asked for leave at 90 days I’ll be eligible for short and long term disability but I shouldn’t even have to do that. That’s just her first suggestion. I personally NEVER mentioned missing a day because I work on weekends for my weeks are freed up. 
Like Come on now it’s a distribution warehouse with 2500+ employees there is something I could be doing Examples include but are NOT limited to: sweeping (that’s an actual job), trash (you literally hook up 🗑 to a cart and drop them off In various areas around the warehouse all night hook the full ones up and take them to the bin where SOMEONE else empties them, people watching boxes go down the conveyor all night If one gets stuck stop it and use a retractor to fix the messed up box requires NO skill Minimum effort🙄 My manager even told me he’s NEVER heard of it before and he asked me who was the lady in hr that I spoke to. Either way I find it strange of them. Especially when I’m only about a month away from 90 days. I don’t see how people are actually defending this at all. Anywho I’ll keep you all updated on the process.

Is there a reason for the weight restrictions like complications or something? I’m only asking because I’m high risk 6 plus c sections a thin scar, and I lift 100+ pound patients daily. I only say this because if not it won’t hurt baby if you were doing it prior to pregnancy, they just don’t want you picking up a lifting habit after getting pregnant if your body isn’t used to it. I would say have your doctor fill it out but if it’s a requirement they could lay you off for it anyways.

Are you living in usa. This is so weird. I live in Germany and nobody can fire you when you are pregnant. 
I think this is totally discrimination. But of course you should check the laws.

Are you sure you aren’t misinterpreting what they said? Clearly they have a mechanism in place for accommodation. Your doctor will fill out  a questionnaire  to justify his note and recommendation and they will approve it if they are satisfied. What’s the problem?
