giving a pass to mentally disabled ?

We have a male coworker(30s) who is considered special needs . He likes to make comments to all the young girls at work calling them hot and taking their pictures without permission . He had an entire spank bank and would have sexual conversations on the phone in our break room , someone would try to include us into the conversation. Finally someone spoke up and they had a large investigation . Another coworker of mine said that we should give him a pass because he isn’t all the way there and it’s not fair that we spoke up & he losses his job.

He’s gone now and my coworker is still saying that we should’ve given him a pass because he had an accident and wasn’t “firing on all cylinders” . The debate came in that we should not have given a pass just because someone isn’t all the way there . Should we give mentally disabled people a pass on sexual harassment because they don’t understand what they’re doing is wrong?
