Freaking out!!

Does anyone know how FMLA works in IL? My work schedule just got turned upside down- I went from a 9-5 Mon- Fri to  8-8 with weekends and a crazy load of work. The stress is causing frequent panic attacks.... Idk what to do. Feeling helpless

Fmla is federal and only gives you job protection for 12 months but does not guruntee pay. That is up to the discretion of your job or state sadly.

It must be only your company because federal only gives 12 weeks and it does not have to be paid.

I understand that this is one of the more confusing areas of FMLA, but as my HR office explained to me, the medical fmla and family bonding FMLA are two separate banks of time. the recovery from the birth comes out of medical, and the parental leave that both parents are eligible comes from a second pool. I wondered if this was just my hr departments interpretation, but my doctors office submitted the doctor's authorization in the same format - 6-8 weeks for the recovery from the birth from the standard 12 weeks of medical, and up to 12 weeks of family bonding (fmla calls this parental vs pregnancy leave). if your HR department does t understand this, your doctor's medical records office might be able to help.

FMLA only ensures your job is held for 12 weeks. Any additional time is up to your company to allow, not FMLA. So not everyone gets "family bonding" in addition to the recovery time.

You may also qualify for short term disability where you could get 60% of your wages while on maternity leave. Definitely talk to HR. They have to give you this information as an employee regardless of whether you're pregnant or not. Also FMLA only kicks in after you use up any vacation or PTO you have with your employer.

exacrly, with fmla the clock starts ticking at birth, regardless of an employers policies on taking PTO to cover the leave with pay.

Yea I couldn't get STD bc I was already pregnant. She should definitely check with Her HR I have and use my FMLA intermittently for days off and I don't have to use my PTO if I don't want to. And it doesn't only apply after you use your PTO time. It's FMLA use it how you please when you sick.

They can't do that. The information should have been given to you in an employee handbook upon hire as well. Here it is a minimum of 1250 minimum hours worked in the last 12 months as well as being employed for the past year based on how many employee the company has. Then from there you would get paid if the company provides or you pay for std or you have pto/vacation/sick time.

I'm a Nurse in IL. This is my first baby and my job actually told me to apply for FMLA. As long as you have been there 12mths you qualify for it. And you can use it whenever you need it. I used a day out of it today because I was cramping and feeling drained. It is not paid leave but you won't be fired if you take the day off. We are carrying a child we need it! Hope this helps and speak to your Dr. Just tell them you need FMLA papers and they send them directly to your job.

Also fmla won't govern your working schedule, only the leave. If you can get your doctor to mandate you leave work, you might be eligible for job protection, but fmla won't guarantee you any kind of paid leave.

What specific questions do you have? FMLA is a federal law so it's the same in every state. The state of IL does not have their own specific medical or maternity leave, only FMLA.
