shared custody

my bf has "50/50" with his sons mother. BUT everytime it's her weekend she asks if he can watch him because she's busy. Say we were to go to court to make it that she has him every other weekend how likely is it that a judge would side with him. the 2.5 days that she does have him he doesn't even spend with her. She leaves him with her grandparents.
