Be "let off easy" for not having proper documentation on the pets they let people adopt?

My cousin just had to give back a dog they adopted because the information was inadequate. She had to contact the previous owners to see what was wrong, and why she was surrendered.

She has two little girls (5 and 2) that like to hug dogs. That shouldn't be a problem but because the dog they adopted has two ruptured disc, she would growl and bite the girls. It took my cousins vet four visits to determine that is what was wrong with her.

She was labeled as non aggressive and kid friendly.

The representative is claiming they are not held liable for not providing information on the dog, because they gave her a trial period of 3 days, had their vet check her out (once), and they are a no kill shelter so they have an excuse as to not having all the paperwork.

This is an actual shelter run by a corporation in the state she lives in.

What are your thoughts on this?

Edit - Yes dogs should not be hugged, I'll copy word for word what it said on her papers,

"She is very good with all children, loves rough housing and loves kids hugs, she let's little ones ride on her back and is ok with poking and prodding by kiddos, all around great dog....""...... No health concerns other than seasonal allergies..."".... she is UTD(up to date) on all her shots (she was not) and took them very well....."

She was given a hug once by the two year old, but her hard, and anytime the two year old came within about two feet of her, (my guess of distance, I only saw three instances though,) she would snap, try to bite, and growl at the 2 year old. They had her for 2 and a half ish months. Visits for 2 weeks before hand, and in their house for two and a half months.
