* EX: your job deciding that if you're using their insurance you should abstain from smoking. If you smoke anyways & get tobacco related illnesses (i.e. Lung cancer) the costs will not be covered.

No. Those are private matters. Everyone is entitled to health insurance. That's right I said entitled. And I mean it too.

Slippery slope. Who's to stop them from mandating exercise, or specific food choices? Hell, who's to stop them from mandating you move to a purely soylent diet?

Then why not just state you smoke on the insurance. We you pay more but at least then if something happens they will still pay out. Besides most insurances won't cover you if you already have a life threatening illness like a cancer. If you start your coverage before you start smoking, and later develop the cancer they should still cover you. But that's for normal out of work insurance. Being in the financial advisor I would HIGHLY suggest that anyone that gets insurance with their job get another outside of the job.

I voted yes because my employer pays our insurance premiums. Someone that is a smoker pays a higher premium, so he then only pays the base (non smoker premium) and the person has to pay the difference

Legally they can to an extent, the ACA offered some protections from them being allowed to obtain certain information. It also offered a way to incentives based on health criteria not necessarily penalize.
