Court question

My ex is threatening me with joint custody, he lives in a different state and never visits the baby and never even ft me or calls just texts once in a while he is in school and when he gets out and get a job he’s going to try to get joint custody by that time my son will be one and a half and he’s already funny with people as it is does he have right to joint custody?
