Separation

Okay, so my soon to be ex husband and I are getting a separation, we have the separation papers and they are all filled out but he is in texas and I moved back to Maryland in January and he still has to mail me the papers so I can take them to were I’m supposed to take them but he’s taking his good old time doing that, but since we have technically been separated for a while, when it gets to be a year that I’ve moved back and the papers aren’t in yet, could I still file for divorce? Are we technically legally separated? We don’t even talk anymore. I’m just confused on the situation.
