Should I take legal action?
Hi there ladies,
I am currently 23 weeks pregnant and just resigned from work a little over a week ago after being there for only 3 months.
This was due to unfair treatment and payment and my partner and i decided it would be best if i left.
I was working in a nursery school with all age groups from 2 months old up until 4 years old.
There was an outbreak of chickenpox about a month ago in the class that I typically worked in and the manager had asked me to work in a different room that day and asked if I had even had chickenpox which I told her that I had not.
The following day she made me return to the class where the child had been (the child was booked off sick).
The child returned a few days (about 4 days) later and I raised the concern of working near her and my manager insisted that I was fine and that even if I did get sick, my child would have a low risk of anything happening to her.
When I raised my concerns again she got irritable and made me feel as though I was on thin ice.
Fast forward to now and I had had morning sickness last week Friday so I stayed at home. When I returned to work on the Monday everything seemed fine until a mother brought her son in and told another teacher that he was feeling better (he had chickenpox that had started healing).
When I had asked the teacher if I should be working he informed me that I was fine and the child was no longer contagious.
Midday I was playing with some learners when I noticed spots on another learner. I asked about this and asked if she was contagious and they insured me that she was not.
I worked again on the Tuesday (my last day) and kept my distance as much as possible.
I have now had chickenpox for the past 2 days and have been informed that there is still a risk to my baby especially if I get chest problems.
I am furious and now know that I should have done my own research instead of trusting what they had said.
I never thought any company would put themselves at legal risk like this.
Is there anyone who knows the British law and knows what I can do about this? Please any advice is welcome.
(We have only been living in the UK for a year and still unsure about these kinds of laws)
