To keep it short and simple his mom called him a nigher lover so I said she’s not allowed over there and he tried to kill him self so I said for no he needs to have visitation when I’m around until I know he’s stable again he continues to argue with me I’m trying to be mature but idk what else to do. Will a judge really force me to let her racist ass see my daughter ? Here go some of the messages I know it’s a lot but please read them and give me some advice. Btw I’ve already packed up to leave I was just being petty by saying that and I shouldn’t of done that.

I’m a paralegal at a family law firm in Jacksonville fl., for one do not delete those texts. If you can prove that the father of your child is unstable that is enough for the court to award you full custody it will likely be temporary because most courts do like to give moms or dads a chance to straighten up, so they would likely court order him to some help. Now during that time his mother has no rights to your daughter. I personally wouldn’t want my child around that either and the fact he’s trying to blackmail you with rent is worse. If he was exhibiting good parenting he would pay the rent knowing it’s keeping his daughter safe and not threatening to take it from you and your daughter. The courts will see that if you keep texts like the ones above. Always keep a paper-trail.

You both sound like you need help learning to coparent. What I got from this is his mom said it once when your child wasn’t there. Your ex is worked up because you are basically saying she can’t be around his family and the court is absolutely going to side with you. If this were a man saying it to a woman we would be seeing a different reaction. Where I live, it’s actually 50/50 that is decided unless one parent can prove the other is unfit. I just don’t see that here. I just feel that it has to be a really big reason to keep your child from a whole family they have.

A judge isn't going to limit who can be around the child unless you can prove that they have harmed your child physically or emotionally, and even then most of the times it will be that the person can be around the child as long as one of the parents is present.

Depends on where you live but almost ALWAYS you will get the child. I’m from way south so in court 97.6% of trials end w mother with custody. 🤷🏻‍♀️ especially if dad is acting this immature. Good luck, I truly hope you stick by your word and get your baby outta that.

Do you have proof that he tried to kill himself and the date? If its within the last 2-3 years I think that alone will require him visitation supervised and if you dont want to supervise it, in the state of PA he would have to pay an hourly rate to a visitation center.
I agree with your decision to not have her around his mother for what she has said, but I don't think that will keep her away from your little girl forever unfortunately.. I am kinda appalled at some responses to be honest - his mother only said the N* word once so you need help coparenting and basically to get over it? He is practically blackmailing you with rent money and forcing you to move bc you wont do what he tells you to do? He also constantly uses the F word to you and I ddint see you use it once.
F* him, and let him make to first move with taking you to court. Save all those texts (print them out so in case your phone shits the bed you don't lose them) and let the burden go on him to go thru court. I guarantee from what he seems like from his texts he wont put in the effort or money to take you to court to get visitation legally..

Also, if he gets custody, his time is his time. He can take her to see his family. You’d have to add a stipulation with the court order but I doubt they will agree.
