Returning to Work

Amanda • 30/ 🇨🇦 / Baby Girl born 08/29/19

This question is for Canadian moms as I’m sure it’s completely different in other countries.

My mat leave is over August 30th and I’m due to go back to work first week of September. However, I think it’s best for our family if I don’t return to work. Did anyone else not return to work after their mat leave was over and was there any issues with your EI? My work isn’t paying a top up, so I’m just getting the 55%.

I’ll have to email my boss about me not returning because of Covid and I want to give him as much notice as possible.

Sorry, I should clarify Covid isn’t my reason for not returning. I would just have to email my boss instead of discussing in person because of it

Noooo no you don’t owe your mat leave! You worked hard & earned that! You just wouldn’t have an income

Yep! I wasn’t sure if I’d have to pay any EI back from my current mat leave or if my boss were to change my employment status before the end of my Mat leave if my EI would end early. Like if I give him notice and he changes my employment status in like June or July if I would still receive EI until end of August.

That shouldn’t be an issue, you just will stop getting EI when your claim runs out in August. And then you wouldn’t be eligible for EI in the future unless you did go back to work and got the minimum number of hours. Is that what you’re asking?

You will automatically be switched to CERB. EI is literally nonexistent atm. I’d been on sick leave since mid March, & I got switched over to CERB a few weeks ago. If I were you I would wait because they are starting the reopening plan. Which means there’s a potential by that point that they may change the eligibility for CERB or EI matters related to covid. I wouldn’t call your boss or try to arrange anything until beginning of July

The only thing CERB doesn’t cover is mat leave. That’s why it didn’t change. Sorry I think I misunderstood, I thought you were looking to go on EI once you were done your mat leave because you were concerned about returning to work. In that case yes you’d be put on CERB if it is still available

I’m still receiving my mat leave EI. Mine didn’t change to CERB and I’m not expecting it to change to cerb once my EI runs out, if all of this is even going on by then.

Or even beginning of august. Because that’s still a months notice

Your EI will end as it should and you’ll have no income if you don’t go back to work. If you apply for CERB you will receive it but eventually they’ll find out that you voluntarily left your workplace and owe it all back.
