It sounds really stupid but I'm so curious. I've never actually said to my partner "it's okay to have sex" or anything along those lines 😂 even our first time haha (we were kissing and one thing lead to another but I never verbally said let's do this haha) obviously he knows I give constant because if I didn't I'd say no (done that a few times) but I've never actually said yes. Just wondering because I seen a post saying "if you don't actually say yes and don't give constant consent then it's rape" but I kinda disagree...

I've never actually said yes either.. it's more of I consent until I say otherwise and when I do say otherwise everything stops. I never realised until just then that I've never given "a massive enthusiast yes" which is according to most what you need in order for it to not be rape. But I've never said no or come off that I don't want it and when I do say no everything stops

But in relationships, it is different. Y'all can have your own nvrbl systems and that's fine as long as your respecting each other. But when you're single, I think it is really important to have verbal consent. Some girls freeze up, for example.

Nope. Never. I never agreed with the "if you don't say yes it's rape." I've been raped multiple times. But with my husband I've never verbally consented

I love this question. Consent and the law around it are very interesting and leave a lot of room for ambiguity. I have absolutely given verbal consent, and often still do with my husband, but that's not really the root of this question. 
Anything but definitive consent may be rape. Likewise, consent can be withdrawn at any point in time, making a continuation of the act sexual assault or rape. Definitive consent doesn't necessarily need to be verbal, though, but that can add clarity especially for first time partners. Consent can be clouded by mind-altering substances (usually alcohol). Legally speaking, someone under the influence cannot consent. But where is the line? It's different for everyone, and one of the reasons so few sexual assaults or rapes are ever prosecuted. 
But let's separate out for a moment the issue of criminal conduct and victim impact. If someone feels like they were raped, regardless of murky consent, they will likely experience many of the same psychological effects as someone in the same situation that clearly said "no". The criminal liability may be different, but the end result for the victim often isn't. 
The criminality of rape is often linked to intent, for better or worse. After all, someone who kills someone while driving drunk has no intent to kill, but they did have intent to drive drunk, and the punishment is often for the result despite the intent. If a man gets a woman drunk hoping to score but she's too drunk to consent, his intent wasn't to rape, but he did have an intent. Is that rape? 
There's a lot of gray area here. I think the important thing is that all victims are treated with kindness and empathy and situations are evaluated objectively and based on their original context.
