Does everyone deserve to be treated humanely/have basic human rights?

I mean things like getting a fair trial, not being subject to cruel and unusual punishment or arbitrary execution. 

I think it's easy for people to pay lip service to human rights, but the moment it's in the context of a bad person/someone they don't like, they want to carve out exceptions. 

But I think that's wrong, because the issue isn't what you think someone else deserves, but what kind of society you want to live in. Do you want to live in a society that condones torture? One that doesn't treat people as innocent until proven guilty? I think that once you start talking about who "deserves" to be treated fairly, you've given up on the idea of rights, and are actually supporting something scary. Because you never know when someone might decide that you don't "deserve" fair treatment, either, and you won't have a leg to stand on.
