Advice? Credit card in collections being taken to court

So my husband insisted that they would never actually take his case to court and instead ignored all of the mail they’ve sent over the past year for his card. We stopped being able to pay it when his minimum hit $300/month because, seriously, how can anyone actually afford that. I regret not “losing” the card on him before he let it get that bad. Now he has a week to write a statement for why he shouldn’t be responsible for the balance that collection is demanding before they decide if they want to proceed to schedule a court date. Has anyone had any success with getting a case like this dropped through their letter? There’s no possible way for us to pay it, not even in payments.

Credit cards aren’t free money - if you couldn’t pay it back you should not have gotten one. You can explain your fiscal difficulties but honestly if he chose to ignore the statements it will most likely go to court. You can’t workout ANY payment plan with them?

call them . COMMUNICATE with them . they WILL sue you . then you WILL be responsible for court fees , and lawyer fees . credit cards are free money . regardless, you WILL have to pay it or file for bankruptcy even then is more lawyer fees . they will settle as long as you communicate with them . make your damn payments and tell your husband to grow up . you will be responsible for his debt as well . so .

Ignoring them will not do anything...call them and see what you can work out. You have to be able to pay SOMETHING..$50?! It sounds like your husband needs to get his crap together and take responsibility for his lack of responsibility. I get it, things can get out of control quickly, but he needs to make things right before they get worse. If he has to deliver pizzas for a while to make the payment, so be it....

Why not either call the credit card company and see if they can settle with you for one low monthly payment. Or consider consolidating you're credit card debt? You could also see about getting a balance transfer by opening up a new credit card?  Sometimes, when you call the credit company, and give em a good sob story, sometimes they'll settle with you. Some may even remove the interest, and just allow you to pay what you actually owe. The only thing is, they may want you to make that payment immediately, or they may set up a payment plan. Consolidating works wonders too... The financial relief programs will basically settle with the credit company's on YOUR behalf and it will lower your monthly payment over the course of 2, 3 or 4 years. This would allow you to avoid going to court and/or filing bankruptcy.

Been there done that. I learned through our lawyer that all the letter will really do is buy you a little time, unless you have a real legit reason for the balance and why it’s so high with no payments. Even then, it needs to be a really good excuse. We wound up filing the scary B word. Not our ideal situation, but our credit is now better off than it was. Our lawyer actually instructed us to write the letters and take them to the court house before the court date to buy us the time to get everything filed. We did it all before the rescheduled date. A little back story Incase anyone feels like lecturing...lol Our situation arose when we moved and I couldn’t find work for an entire year. We had to live off the 2 CC’s we had. And then as mentioned above, the min payments became unaffordable. Good luck, hopefully you all can get it straightened out and the little bit of info I shared helps some.

I don't think there's any plausible excuse he can make. However, some people have had success in simple accepting the amount they owe but argue that it's not feasible for them to meet $300/month and instead suggest an alternative pay amount and a schedule for the payments to be made.

So.......if there’s no possible way to pay it, why even buy the items you bought ?!?!?!?! Also, if you can’t pay ANYTHING, they can literally take your car if they wanted to 🤷🏻‍♀️

If you ignore money problems they grow. Since he didn't talk to them when they called they will now take legal action. They will get their money. You will have to pay them back what he owes. There is not likely a way out of it, get a loan or file bankruptcy. His and your credit should be checked as it's probably very damaged.

I didn’t know credit card companies did this. The balance must be really high. All the credit cards I’ve had just sent threatening letters and then they’d settle for like 1/4 of the amount.
