Dog in our Will - need help

So we got our dog from a rescue as a puppy. When we got him we had to sign a contract saying if we didnt want him anymore we were not allowed to rehome him ourselves (like to a relative or otherwise). We would have to return him to their rescue and they would take responsibility to rehome him. Not hst we would consider that unless under extreme circumstances.. very extreme. We are team "a pet is for life" type people. So when we were updating our will this past week, my husband made a point wondering if we could "rehome" our dog with the family that would receive our son. The family taking our son agreed that it would be fine (my aunt and uncle. They have 2 dogs and a bigger yard than we do). We contacted the rescue saying under extreme circumstances such as my husbands and my demise, could our dog go with our son without any legal recourse (if they found out we rehomed him we would have to settle for $3,000.00 or go to court for breaking contract). They said NO. My family would ha e to give the dog back to the rescue, apply to adopt him, and pay an adoption fee, and receive him back before a different family adopted him. We are appalled. My son would be losing us, plus possibly his best friend. We are wondering if there is anything to get out of this contract. The dog is ours, we adopted him, why does this rescue have a say where he is to go if a catastrophic event were to happen to his family.
