He is married legally and what would you do.

My SO is still going through his divorce because they are still fighting custody terms over their son. We have been together 10 months and feel unexpectedly pregnant a few months ago. We unfortunately lost the baby recently and although we talk about waiting out the divorce to be finalized..my heart is not wanting to. But, I also want more time to enjoy each other without a baby. We have 4 between the two of us already. We've known each other 2 1/2 years but only together these 10 months.

The judge already knows we live together and the extent of our relationship so I know that wouldn't be a factor but there is still the fact he is legally married.

I'm so torn.
