DNA test

So since i was twelve I had been talked into sleeping with my childs father. He would get me to drink or something etc and i wasnt raised in a good home. I thought all that was normal he is 27 and im 23 now. Last year on mothers day he decided to rape me thru a supervised visit. He pressed child support on himself but waived the paternity test in 2017. So I press rape charges but he is skating by due to covid they didnt give me a rape kit immediately so its really hard to prove that he did. But I have a walking child from the rape in 2014. The problem is i must get dna to prove this. He did however take a paternity test with my youngest child and it came out negative. He was smarter than i thought he was unfortunately. I asked for the papers with the last child and called the dna test place but they wont compare it without a sample even though this is on file. Has anyone else dealt with this? Have you gotten a paternity test without a sample before? I cant legally go near him because of the open rape test.
