I have a question for a lawyer

My mom just found out that instead of having the complete hysterectomy that she was told she had and that the doctor put through to her insurance (mom called and they confirmed everything should have been taken based on the code) she still has her ovaries and fallopian tubes. My mom disclosed to the doctor that she has a family history of ovarian cancer and the doctor herself recommended that she have the complete hysterectomy because she had patients come back after partial hysterectomies with cancer. She hasn't been to see a gynecologist in a decade because she thought everything was taken and she now has fluid in a fallopian tube and a mass on one of her ovaries and will need to have yet another surgery to remove them. She's in the process of trying to get the records of her surgery and she's worried they might be gone. If the hospital no longer has the records can anything be done?
